Solicitation Title:  Advocacy Services for DHS Facilities

Proposed Method of Procurement:  
Description:  Advocacy Services for DHS facilities, to include those for the Office of Developmental Programs, the Office of Children, Youth, and Families, and the Office of Mental Health and Substance Abuse Services.  This will include:

  A. Assist in identifying all individuals in need by priority of advocacy services. This will be accomplished by meeting with individuals, their teams and their family and friends if available. Once identified, a priority list of individuals will be developed and submitted to the Center Director or designee.

B. Meet, advocate will with individuals identified to explain the purpose and function of an advocate and to begin to establish a positive relationship that will extend to other family members, if present, friends and staff who work closely with the person.

C. Represent individual in Interdisciplinary (IDT) Team processes as needed; participates as a team member, uses professional experience, habilitation and program expertise, as well as personal insights to assist and guide other team professionals in developing services and problem-solving approaches, which are in the individual's best interests, meets the person's needs and provides maximum habilitation benefit.

D. Monitor services by conducting on-site announced and unannounced visits to individuals' day and residential programs to assure that services are occurring as planned and are meeting the individual's needs. Review and take action as appropriate and necessary to resolve identified issues.

E. Review record documentation to familiarize him/herself with individual's health status together with past and present goals, objectives, likes and dislikes, etc. Meet with associated team members including family and friends for additional information as needed.

F. Work with regional office, county, state center and provider staff to assist in facilitating individuals' movement into the community.

a. Actively monitor all aspects of planning for the person's move to the community which may include transitional visits.

b. Identify and work with advocates within the community including those connected with community programs and self-advocacy support groups.

c. May accompany state center staff on post discharge monitoring visits, if desired.


G. For all individuals residing at the Center:

a. Randomly attend ISPs and represent individual in Interdisciplinary (ID) Team processes; participates as a team member, uses professional experience, habilitation and program expertise, as well as personal insights to assist and guide other team professionals in developing services and problem-solving approaches, which are in the individual's best interests, meets the person's needs and provides maximum habilitation benefit.

b. Randomly monitor services by conducting on-site announced and unannounced visits to day and residential programs to assure that services are occurring as planned and are meeting the individual's needs. Review and take action as appropriate and necessary to resolve identified issues.


H. Organize and lead a self-advocacy group at each assigned Center.

I. Participate in the annual presentation of each individual's review of their rights and responsibilities and assisting the individual in understanding information presented.

1. Inform and educate staff members about individuals' rights by organizing and conducting training programs designed to foster the implementation of individuals' rights.

2. Training includes formal and informal orientation sessions to explain the rights of individuals, responsibilities of staff to protect a person’s rights and the process in place to file a rights violation complaint.

J. Assist and educate individuals who express a desire to vote.  This includes registration, impartial review of candidates and issues as well as the actual voting process.

K. Immediately report to the Center Director or designee, per the established center policy for any incident involving alleged or suspected abuse of individuals’ rights, neglect in treatment and care, physical injury of individual or any other issue of concern.

L. Actively participate in the Center’s Risk Management, Behavior Support, Incident Management, Investigation Review Process, Human Rights Committee, local and statewide Quality Management meetings, strategies and initiatives.

M. Participate in independent group of developmental disability professionals to discuss living options for people, as requested.

N. Maintain a complaint system with individuals' assistance to file complaints about alleged violation of rights.

1. Interview individuals wishing to file a complaint; define and clarify issues, making determinations as to whether or not allegations deal with rights' violation and assist individuals in writing complaints.

2. Investigate complaints made by individuals and others to determine complaint validity and scope.

3. Immediately report to the Center Director or designee, per the established center policy for any incident involving alleged or suspected abuse of individuals’ rights, neglect in treatment and care, physical injury of individual or any other issue of concern.

4. Inform individual of outcome of allegations and of right to appeal to Center Director.

O. Conduct training programs on individual rights to inform and educate individuals, their families and employees to assist them to understand individuals' rights, how they are to obtain them under applicable state and federal laws, regulations and procedures, and how to file complaints alleging rights' violations.

P. Provide technical assistance and guidance to Center staff and administration on individual rights.

Q. Prepare monthly reports including the following, and submit to Bureau of State Operated Facilities: 

a. Summarization of activities
b. Open concerns to be addressed
c. Recommendations to improve services provided

R. Satisfaction surveys
a. Complete annually
b. Survey form to be agreed upon by the Bureau of State Operated Facilities and the Advocacy vendor.
