This request for proposals (RFP) provides to those law firms interested in submitting proposals for the subject procurement (“Offerors”) sufficient information to enable them to prepare and submit proposals for the Governor’s Office of General Counsel’s consideration on behalf of the Commonwealth of Pennsylvania (“Commonwealth”) to satisfy a need for legal services to provide workers’ compensation defense counsel for several programs administered by the Department of Labor and Industry (“L&I”), including the State Workers’ Insurance Fund (“SWIF”), Uninsured Employers’ Guarantee Fund (“UEGF”) and Self Insurance Guarantee Fund (“SIGF”).
This RFP is issued pursuant to Executive Order 2015-2 dated January 20, 2015, and in accordance with Section 518 of the Commonwealth Procurement Code, 62 P.S. § 518 and Part III Chapter 8 of the DGS Procurement Handbook.
This is an RFP to supplement counsel selected as a result of RFP OGC-2015-50. If your firm was awarded a contract as a prime contractor for this engagement (OGC-2015-50), do not submit a proposal. If a current prime counsel does submit a proposal, your firm risks losing your prime contract as a result of your proposal to RFP OGC-2017-04 being reevaluated and not selected. If your firm was awarded a contract as conflict counsel for this engagement (OGC-2015-50), you are welcome to submit a new proposal with respect to RFP OGC-2017-04, with the possibility of converting that conflict counsel contract into a prime contract. However, be advised that your firm also runs the risk of losing your contract as conflict counsel completely, if your submission for OGC-2017-04 is not selected. Current conflict counsel who choose not to submit a proposal to this RFP will not have a change in status.
