Description:
|
SWIF seeks vendor(s), which can provide an integrated combination of claim analysis and legal services, to identify and handle specialized, high-level subrogation claims against entities whose products, services or actions may have caused or exacerbated a covered work injury. For example, such claim could include a claim against a manufacturer for the increased medical expenses related to a prescribed drug that is subsequently found to cause additional injury or a medical device, such as a hip implant or knee replacement, which improperly fails.
Because there may be many opportunities for subrogation, SWIF proposes a multiple award RFP in order to take advantage of vendors’ differing expertise and to identify all potential subrogation opportunities available to SWIF.
In addition to handling the subrogation claim, the successful vendor(s) will assist SWIF in analyzing its existing workers’ compensation claims to identify actual or potential subrogation claims; and to develop a coding process or other mechanism to earmark claims with potential subrogation issues for monitoring.
It is expected that this contract should result in no additional cost to the Commonwealth as vendors will be paid through receipt of a set percentage (likely 20%) of recovery amounts obtained by their respective efforts.
